Guarantees by Breeder

1. Seller is transferring this kitten to buyer in good faith as a healthy and well cared for animal. Seller guarantees this kitten to be free from feline leukemia virus (FeLV) and feline immunodeficiency virus (FIV) at the time of sale. This kitten is guaranteed to be of sound health at the time of sale and for a period of 72 hours from the date of sale. Buyer is encouraged to have the kitten checked by a veterinarian of Buyer’s own preference within 72 hours from the date of sale. If within this 72 hour period the kitten is deemed by Buyer’s veterinarian to be unsuitable for health reasons, the kitten may be returned to seller for a full refund of the original purchase price. Any medical care given to the kitten during this 72 hour period shall be the Buyer’s sole expense. Buyer shall not deny the kitten needed veterinary attention. If buyer provides a written statement, with accompanying documentation from a duly licensed veterinarian within 72 hours from the date of sale, that the kitten is not of sound health, the kitten may be returned to Seller in exchange for a full refund of the original purchase price only. Under no circumstances will the Seller be responsible for any veterinary costs associated with the kitten. All costs associated with returning the kitten to the Seller will be the sole expense of the Buyer. This health guarantee shall be void if (a) it is determined by a license veterinarian during the 72 hours period following date of sale that the kitten is not of sound health and the Buyer elects to keep the kitten notwithstanding health defects, or (b) if Buyer fails to have the kitten examined by a duly licensed veterinarian during the 72 hour period.

2. The kitten is guaranteed against congenital defects of the heart, liver and kidneys which result in the kitten's death until the age of twelve (12) months. Should the kitten die on or before the age of twelve (12) months, from a congenital defect, the kitten will be replaced upon receipt (hereinafter “Date Of Return”) of (a) signed statement from a licensed veterinarian stating the exact cause of death (b) an autopsy report, (c) a signed statement of the health and shot records for the kitten, (d) the cause of death is a direct and proximate cause of a genetic defect, and (e) Buyer provides this information within 14 days from the date of death. Replacement will be made with a kitten of comparable quality. Seller shall have six (6) months from the Date Of Return to provide Buyer with a comparable replacement, if no comparable replacement is available on the Date Of Return. Seller reserves the right to refund Buyer’s purchase price in lieu of replacement.

3. Breeder makes no guarantee as to the show quality of the cat/kitten listed above.

Responsibilities of Buyer

1. The kitten will be loved and treated as a family member.

2. Buyer promises and warrants that this cat/kitten will be an INDOOR ONLY animal, not allowed outdoors except in a protected, enclosed area, a carrier or on a leash.

3. Buyer will not confine this cat/kitten to a cage for extended periods of time.

4. Buyer agrees that the cat/kitten will NEVER BE DECLAWED. If the buyer has the kitten de-clawed, the Health Guarantee shall be null and void.

5. Buyer insures the cat/kitten will receive regular veterinary care including at least an annual exam, vaccination boosters, as well as any needed veterinary attention. If the buyer is unsure whether veterinary care is warranted, a vet will be contacted, the situation explained and the veterinarians’ advice acted on.

6. Cat/kitten will receive kind and frequent human attention.

7. Cat/kitten will be given proper diet and will have access to dry food and fresh water at all times.

8. Seller does not immunize the kitten FIP (feline infectious peritonitis) or FeLV (feline leukemia virus) prior to sale, as these vaccines can depress the immune system of healthy cats. If buyer immunizes the kitten for FIP or FeLV, the health guarantee hereunder shall be null and void.

9. If at any time the cat/kitten is found to be ill, malnourished, abused, neglected, or unattended outdoors, buyer will surrender cat/kitten unconditionally to Seller with no refund of purchase price. Failure to surrender cat/kitten in above circumstances will lead to Seller’s starting legal action.

10. Under no circumstances will this cat/kitten ever be abandoned, sold, leased, given away to any pet shop, humane society, pound, shelter, research facility, or euthanized for behavioral problems. If for any reason buyer cannot keep cat/kitten, Seller will be notified immediately PRIOR to any disposition of said cat/kitten. Seller then has the option to take back cat/kitten and/or to help find another suitable home. Buyer will not be reimbursed for purchase price. It is the intention of the Seller that this is a permanent placement. This kitten is not allowed to be sold or leased to another person for any circumstances.

11. This kitten is intended to be a household pet. Neutering or spaying is REQUIRED between four (4) months of age and no later than seven (7) months for females and nine (9) months for males. Buyer agrees not to allow this kitten to produce offspring. Once a statement of spay or neuter has been provided to Seller from Buyer’s veterinarian, seller will provide registration paperwork to the buyer.

12. Buyer agrees to notify breeders of any change in address or phone numbers; of any health problems; loss or death of the cat/kitten.

13. Buyer will not use clumping litter for at least the first six (6) months of the kitten’s life as kittens sometimes eat kitty litter and if ingested, clumping litter may have adverse health consequences including, but not limited to, intestinal blockages. Buyer bears sole responsibility for any health risks associated with using clumping litter.

Exclusions and Amendments to this contract
1. Failure to honor any part of this contract may result in legal action brought by Seller against Buyer. All legal fees and court costs necessary to enforce this contract, including those incurred by the Seller, will be obligation of the buyer(s). Should any of this contract be found illegal or unenforceable in a court of law in the Commonwealth of Massachusetts, sale to be instituted in same, the remainder of this contract is to remain valid and enforceable.

2. Buyer agrees that the contract will be bound by the laws of the Commonwealth of Massachusetts and that any dispute regarding this contract will be settled in a court of law in the Commonwealth Of Massachusetts.

3. Deposit made upon execution of this contract is NON-REFUNDABLE except in the event that breeder cannot meet the guarantee at the time of adoption.

4. Seller’s liability hereunder shall be limited to the purchase price of the kitten, which shall be the Buyer’s sole remedy in equity and law as liquidated damages hereunder.

In as much as the below signed buyer(s) have read and understood the terms and restrictions of the sale and understand that this contract is a legal and binding agreement, enforceable within the confines of the United States and the costs incurred in interstate litigation by the breeders are within the accepted responsibilities of the buyer(s), this contract is legal and effectual and enforceable document within and by all the boundaries of this United States and Canada.
